Terms of Service

1. Acceptance of Terms

By accessing or using As Pretty As A Picture ("the Service"), operated by KasmoK LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

The Service provides AI-powered photo enhancement (PrettyEnhance) and AI-powered photography feedback (PhotoCritic). You upload images, and our AI processes them to produce enhanced versions or written critiques.

3. User Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must be at least 13 years old to use the Service.

4. Image Usage & Ownership

  • You retain full ownership of any images you upload.
  • By uploading an image, you grant us a limited, non-exclusive license to process the image solely for the purpose of providing the Service.
  • We do not use your images for training AI models, advertising, or any purpose other than delivering the requested enhancement or critique.
  • Enhanced images and critiques generated by the Service are yours to use as you wish.

5. Content Policy

You must not upload images that:

  • Contain sexually explicit or pornographic content
  • Depict minors in any inappropriate context
  • Contain violent, gory, or disturbing content
  • Violate any third party's intellectual property or privacy rights
  • Contain illegal content or promote illegal activity

We reserve the right to remove content and suspend accounts that violate this policy without notice.

6. Credits & Payments

  • Free accounts receive 5 credits per month. Pro subscriptions receive 100 credits per month.
  • Each enhancement or critique costs 1 credit. Credits are deducted upon successful processing.
  • Purchased credit packs do not expire. Monthly credits do not roll over.
  • Subscriptions are billed via Stripe. You may cancel at any time; access continues until the end of the billing period.
  • Refunds are handled on a case-by-case basis. Contact us for refund requests.

7. Image Storage & Deletion

  • Uploaded and enhanced images are stored on our servers for your access.
  • You may request deletion of your images at any time by deleting your account.
  • Upon account deletion, all associated images and data are permanently deleted within 30 days.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim. AI-generated results may vary in quality and are not guaranteed to meet specific expectations.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Service. Continued use after changes constitutes acceptance.
